At Hifas Da Terra, the trust of our Customers and Users is paramount, and for this reason, we have drawn up the following Terms and Conditions which will govern the use of our website www.hifasdaterra.com and the commercial relationships arising from the purchase of our products and services. 

Depending on the country of destination for the shipment, the company responsible for sales, invoicing and customer service will be the relevant subsidiary of the Hifas Da Terra group operating in that territory, in accordance with the list published in section 3, entitled “Responsible company and invoicing by country”, of these Terms and Conditions.

These Terms and Conditions aim to establish a clear and precise legal framework that protects the rights of both Customers and our company, in accordance with current national and EU legislation.

By accessing, browsing and using this website, as well as by making any purchase, the Customer unreservedly accepts the following clauses:

5. Registration and Deletion of User Accounts

5.1. Creating an Account

To access certain services and make purchases on the Hifas Da Terra website, the User must create an account. The registration process allows you to choose between two types of profile:

- User: Access to products and services aimed at the general public.


- Healthcare Professional: Access to specialised content, specific products and, where applicable, special terms and conditions.


During registration, details such as name, email address and any other information necessary for the provision of services will be requested. The User must provide accurate, up-to-date and complete information.

By creating an account, the User expressly and unreservedly accepts these Terms of Use and undertakes to:


- Maintain the confidentiality of their account and password.

- Ensure that the information provided is correct and update it if necessary.


The User may access their account at any time to modify their details, manage orders and preferences. If they wish to delete their account, they may do so via the website or by requesting it via email.

5.2. Account Deletion

The User may request the deletion of their account at any time. However, this action is irreversible and will result in the loss of access to the services and features provided by the account.

5.3. User Requirements and Obligations

2. The User is solely responsible for the content they publish or provide on their account. Hifas Da Terra reserves the right to remove any profile that fails to meet these requirements, breaches current regulations or damages the company’s reputation.


5.4. Requirements and Obligations for Healthcare Professionals

Users who register as Healthcare Professionals must meet additional requirements:

- Be over 18 years of age. If the registration represents a company, there must be a natural person responsible for the profile.


- Provide accurate information and not alter details regarding the organisation or company to which they belong.


- Use the information obtained exclusively for the professional purposes indicated.


Failure to comply with these conditions may result in the cancellation of the profile without prior notice.


5.5. Website issues

Hifas Da Terra provides access to its website and services subject to availability, without guaranteeing that they will be free from errors or interruptions at all times.

It shall not be liable for:

- Service interruptions due to causes beyond its control (network failures, server maintenance, etc.).


- Security errors on the User’s device (viruses, malware, outdated browser versions).


- Problems arising from the User’s internet connection.

6. Purchase Process

To purchase products at www.hifasdaterra.co.uk, the Customer must follow these steps:

- Product selection: Browse the online shop, choose the desired products and add them to the shopping basket.


- Order review: Go to the shopping basket to check the selection of products, their quantities and the total amount.


- Billing and delivery details: Fill in your personal and delivery details, ensuring that the information provided is correct and up to date.

In the event that, due to availability issues, a product cannot be dispatched, Hifas Da Terra will inform the Customer and offer an alternative or a refund of the corresponding amount.


7. Purchase subscription service.

Hifas Da Terra offers the option to purchase products via an automatic refill subscription service. 

7.1.  Subscription Terms

Customers who opt for this option will receive  discounts on the unit price of the refill depending on the type of subscription (monthly, quarterly or half-yearly)


7.2. How the subscription works.

- The subscription includes the automatic dispatch of the product to which the customer has subscribed.


- The customer will be notified by email prior to each renewal/delivery.


- The subscription can be modified or cancelled at any time, at no additional cost, directly via the customer portal or by contacting customer service:

7.3. Cancellation of the subscription service

The customer may change the delivery frequency, address or payment method, as well as cancel their subscription at any time, without penalty. To avoid the next delivery, changes must be made at least 48 hours before the scheduled renewal date.


8. Liability

8.1 Liability of Hifas Da Terra 

Hifas Da Terra is committed to providing clear and accurate information about the products available in its online shop, guaranteeing their quality and safety in accordance with current regulations.

However, Hifas Da Terra shall not be liable for:

- Any interruption to the website service due to technical issues, maintenance, updates or problems beyond the company’s control.


- Errors in product prices, descriptions or images where these are obvious and clear.


- Delays in delivery resulting from unforeseen circumstances, force majeure or problems with the transport company.


- Inappropriate use of the products by the Customer, including their consumption under conditions other than those indicated in the product specifications.



8.2 Customer’s Liability

The Customer is responsible for:

- Providing accurate and up-to-date information during the purchase process.


- Using the products purchased in accordance with the instructions provided by Hifas Da Terra and in compliance with the recommendations for use.


- Maintaining the confidentiality of their account in the event of registration on the website.


Hifas Da Terra reserves the right to block, suspend or cancel the account of any Customer who makes fraudulent use of the website, breaches these Terms and Conditions or engages in unlawful activities.

In the event of any misuse of the website or breach of applicable regulations being detected, Hifas Da Terra may take appropriate legal action and report any unlawful activity to the relevant authorities.


9. Prices and Payments

9.1. Prices

The prices of the products offered in the Hifas Da Terra online shop include applicable taxes in accordance with the regulations in force in the destination country of the shipment. However, these prices do not include delivery costs, where applicable, which will be added to the total order amount and will be clearly detailed before the purchase is finalised.

In the case of special promotions or discounts, the final price will be displayed once the conditions applicable to the offer have been applied.

9.2. Pricing errors

Although Hifas Da Terra regularly updates the pricing information on the website, unintentional errors may occur. If an obvious error is detected in the price of a product, we reserve the right to correct it and inform the Customer before processing the order. In this case, the Customer will have the option to confirm the purchase at the correct price or cancel it at no cost.

9.3. Payment methods

The Customer may pay for their orders using the following payment methods:


If you are a B2B customer: Customers with special rates (B2B) can check the different payment methods available with their account manager.


The Customer warrants that they are the legitimate holder of the payment method used and undertakes to notify us immediately of any unauthorised use or incident relating thereto. Hifas Da Terra does not store payment details.

If the payment is not authorised, the order will be automatically cancelled.


10. Shipping and Delivery

10.1. Delivery times and conditions

Hifas Da Terra delivers both nationally and internationally, sending products to the address provided by the customer at the time of purchase.

Delivery times vary depending on the destination and the transport service used. 

Deliveries are made by the Hifas Da Terra group company responsible for the country of dispatch, as indicated in section 3.

During the purchase process, the estimated delivery time will be shown before the order is finalised.

Approximate delivery times are:

- Spain (Mainland), Germany, France, United Kingdom, Italy: 2–3 working days from order confirmation.


- Balearic Islands, Ceuta and Melilla: 3–7 working days.


- Other territories: between 3 and 7 working days, depending on the specific transport and customs conditions of the destination country.


If a product is not in stock at the time of purchase, the Customer will be informed of the estimated restock date or offered an alternative.

10.2. Delivery charges

Shipping costs will be calculated automatically based on the weight of the parcel, the delivery address and the selected carrier. The exact cost will be displayed before the order is finalised.

Hifas Da Terra may offer free delivery on orders exceeding a certain amount, which will be indicated on the website and in the Shipping Policy  .

Shipments outside the European Union may be subject to additional customs charges, duties, local taxes or other charges imposed by the authorities of the destination country. These costs are not included in the product price or in the delivery charges shown during the purchase process.

The customer is responsible for finding out in advance about any import charges applicable in their country and for paying such charges where applicable. Hifas Da Terra cannot control or predict the amount of these additional costs, which will be handled by the customs authorities of the destination country.



10.3. Order Tracking

Once the order has been dispatched, the Customer will receive an email containing useful information about the order status and the associated invoice. Once the order has been dispatched, the Customer will receive an email with a tracking number to check the status of the shipment via the carrier’s website.


10.4. Delivery issues

If the order is delayed for reasons beyond Hifas Da Terra’s control (logistical issues, adverse weather conditions, etc.), the Customer will be informed as soon as possible.

If the courier is unable to deliver the parcel because the customer is not at home, they will attempt a further delivery or leave a note with instructions on how to collect it.

The risk of loss, damage or deterioration of the goods shall pass to the Customer at the moment when the Customer, or a third party authorised by them, takes physical possession of the order. This means that, once the product has been received, any subsequent incident or deterioration shall be the Customer’s responsibility.

It is essential that you inspect the parcel upon delivery. If you notice any visible damage to the packaging or suspect that the product may have been damaged during transit, we recommend that you:

1. Note the issue on the delivery note or in the transport company’s digital receipt system before signing for the delivery.


2. Take photographs of the packaging and the damaged product as evidence.


3. Report the issue within 24 hours of receiving the order by filling in the form on the contact page, stating the order number and a description of the problem, and attaching the relevant images.


If the Customer fails to take these steps within the specified timeframe, it will be more difficult to process any claims with the transport agency or to request replacements or refunds.


11. Right of Withdrawal and Returns

Hifas Da Terra has specific policies regarding order cancellations and a returns and refunds policy , which govern the procedures and conditions applicable in each case. For consumers residing in Member States of the European Union, the right of withdrawal is recognised in accordance with Directive 2011/83/EU of the European Parliament and of the Council on consumer rights, and the national legislation transposing it in each country. This right allows you to cancel the purchase within the established legal timeframe, without needing to justify your decision. For orders placed from countries outside the European Union, the consumer protection regulations in force in the relevant territory shall apply. Detailed information on exercising the right of withdrawal and on the cancellation policies , return and refund is available in the relevant sections of the website.


11.2. Return conditions

For a return to be accepted:

- The product must be unopened and in its original packaging, with no signs of tampering.


- Returns of perishable, personalised products or those that cannot be returned for hygiene reasons will not be accepted, unless they have manufacturing defects.


- The Customer must bear the cost of return postage, except in cases of incorrect delivery or faulty products.


11.3. Refund procedure

Once the return has been received and the condition of the product verified, Hifas Da Terra will refund the amount within a maximum of 14 days using the same payment method used for the purchase.

12. Product Warranty

12.1. Warranty Coverage

The mushroom-based food supplements offered on www.hifasdaterra.co.uk are covered by the statutory warranty in accordance with the Spanish General Law for the Protection of Consumers and Users and European Union regulations (Regulation (EU) 2017/2394 and Directive 2011/83/EU). As these are consumable products for personal use, the guarantee is limited to manufacturing or packaging defects that could compromise the safety or quality of the product prior to opening.

The guarantee does not cover claims relating to health effects, as these products are food supplements that do not replace a balanced diet or medical treatment. It is recommended that you consult a healthcare professional before starting to take any supplement.

If the Customer receives a product that is damaged, in poor condition or has a manufacturing defect, they shall be entitled to:

- Replacement of the damaged product with a new one, provided this is notified within the specified period.


- A refund of the amount paid if replacement is not possible.


Claims and warranty matters will be handled by the company responsible for issuing the purchase invoice, depending on the country of destination (see section 3).

The warranty is valid for 2 years in the following countries: Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Finland, Greece, Hungary, Malta, Monaco, the Netherlands, Poland, Portugal, Sweden and Switzerland, with the exception of the following: 

- Ireland: 6 years (limited to defects present at the time of purchase)


- United Kingdom: 6 years (England, Wales and Northern Ireland); 5 years (Scotland)



12.2. Exclusions from the warranty

Due to the nature of the products sold (food supplements), the warranty does not cover:

- Products that have been opened, tampered with or partially consumed.


- Products whose packaging is damaged after delivery and this has not been reported within the specified timeframe.


- Exchanges or returns for reasons other than manufacturing or packaging defects.


- Misuse or incorrect storage by the Customer (e.g. exposure to excessive heat, humidity or direct light).


- Adverse reactions or unwanted results arising from the use of the products, which may vary from person to person.


12.3. Procedure for making a warranty claim

To make a warranty claim, the Customer must contact Hifas Da Terra’s customer service department and provide:

- Order or invoice number.


- Description of the problem or defect observed.


- Photographs or evidence of the condition of the product and its original packaging.

The User is prohibited from reproducing, transforming, distributing, publicly communicating, making available to the public, extracting, reusing, forwarding or using in any way, by any means or procedure, any content of the website, unless prior, express and written authorisation has been obtained from Hifas Da Terra.

We therefore recommend that Customers and Users review these Terms and Conditions periodically to ensure they are aware of the current terms and conditions applicable at any given time.

Continued use of Hifas Da Terra’s services following any amendment to the Terms and Conditions implies the User’s acceptance of such amendments.


17. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the applicable legislation under international private law and consumer protection regulations. In the event of any dispute or conflict arising in relation to the interpretation, performance or enforcement of these Terms and Conditions, and provided that the Customer is a consumer, the parties agree to submit to the courts having jurisdiction over the Customer’s place of residence, in accordance with the applicable consumer and user protection legislation in force in the Customer’s country of residence.  

In the event that the Customer does not have the status of a consumer, the parties agree to submit, expressly waiving any other jurisdiction that might apply to them, to the courts of the cities of Pontevedra (for Hifas da Terra S.L), Cologne (for Hifas da Terra Germany GmbH), Paris (Hifas da Terra France SAS), Milan (for Hifas da Terra Italia SRL); and London (for Hifas da Terra Ltd.), this being the applicable jurisdiction for the resolution of any dispute that may arise.
